1. Agreement to Terms
By accessing our website or using our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. WK Woburn Concrete reserves the right to modify these terms at any time. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
2. Services Provided
WK Woburn Concrete provides professional concrete installation, repair, and related services for residential and commercial clients. All services are subject to availability and will be performed in accordance with industry standards. We reserve the right to refuse service to anyone for any reason at any time. Service estimates are valid for 30 days unless otherwise stated.
3. Payment Terms
Payment terms will be outlined in your service agreement or estimate. Deposits may be required before work begins. Final payment is due upon completion of services unless other arrangements have been made in writing. We accept cash, checks, and major credit cards. Late payments may be subject to interest charges as permitted by law. If legal action is required to collect payment, you agree to pay all collection costs including reasonable attorney fees.
4. Project Changes and Cancellations
Changes to the scope of work must be requested in writing and may result in additional charges. If you cancel a scheduled service, please provide at least 48 hours notice. Cancellations with less notice may result in cancellation fees. If weather or other conditions beyond our control prevent completion of work, we will reschedule at the earliest opportunity without penalty to either party.
5. Warranties and Guarantees
We stand behind the quality of our work and materials. Specific warranty terms will be provided in your service agreement. Our warranties cover defects in workmanship and materials under normal use conditions. Warranties do not cover damage caused by improper maintenance, accidents, natural disasters, or unauthorized modifications. To make a warranty claim, contact us in writing with details of the issue.
6. Limitation of Liability
WK Woburn Concrete will not be liable for any indirect, incidental, special, or consequential damages arising from our services. Our total liability for any claim will not exceed the amount paid for the specific service in question. We maintain appropriate insurance coverage as required by law. These limitations apply to the fullest extent permitted by applicable law.
7. Property Access and Safety
You agree to provide safe access to the work site and to remove any obstacles that may interfere with our work. Please secure pets and notify us of any underground utilities, irrigation systems, or other hidden features. We will take reasonable precautions to protect your property but are not responsible for damage to unmarked utilities or undisclosed site conditions. You are responsible for obtaining any necessary permits unless otherwise agreed in writing.
8. Intellectual Property
All content on our website, including text, images, logos, and designs, is the property of WK Woburn Concrete or used with permission. You may not reproduce, distribute, or create derivative works from our content without written permission. We may use photos of completed projects for marketing purposes unless you request otherwise in writing.
9. Governing Law
These Terms of Service are governed by the laws of the Commonwealth of Massachusetts without regard to conflict of law principles. Any disputes arising from these terms or our services will be resolved in the courts of Middlesex County, Massachusetts. If any provision of these terms is found unenforceable, the remaining provisions will continue in full effect.
